Acacia Roofing Fails To Pay Supplier, Homeowners Stuck With Liens

JACKSONVILLE, Fla. — Acacia Roofing is sealed up, a company’s Sunbeam Road bureau is dark, and the owners Jimmy Garza is usually holding phone messages.

“I suspicion we did all right,” pronounced Kevin McGinnis, one of several homeowners who would like to hear from Jimmy Garza.

“All we get is voicemail,” he said.

Last year, Acacia Roofing commissioned a new roof on McGinnis’ home costing $8,000. According to an check from a company, it was paid in full, though McGinnis after perceived a notice that a garnishment has been place on his home from SRS thatch supply company.

“For one shock, second anger. we went to Acacia to say, ‘hey, what’s going on with this?’,” he said.

The association pronounced it would take caring of it, though McGinnis said, it hasn’t.

Under Florida’s construction/mechanic garnishment law, given Acacia thatch unsuccessful to compensate SRS, a association is authorised to insert a garnishment to McGinnis’ home. To mislay a lien, McGinnis has to compensate a check again.

“They’re looking for $4,000 that we already paid; we don’t have it,” pronounced McGinnis.

ON YOUR SIDE

McGinnis is not alone. Several of Acacia Roofing customers have combined a Facebook page to voice their frustrations. They too  have liens on their homes.

“I trust a thatch association knew what was going on with Acacia and shouldn’t do this,” pronounced patron Bill Dolsen.

Garza pronounced he had a prolonged operative attribute with SRS Roofing Supply. He had due a association $350,000, but had paid it down to $150,000 when their attribute soured.

“I have sole all that we own. we only sole my lorry to compensate off dual liens,” pronounced Garza, who pronounced he has already paid off about 12 liens.

Clay County justice annals show Acacia thatch and Garza had a run of financial problems, along with an IRS taxation garnishment on a association for $963,000. “I am still profitable on that,” pronounced Garza.

Tom Stephens, boss of a Better Business Bureau, pronounced Acacia Roofing was a member in good station until now.

“We’ve had a series of complaints in a final 30 days,” pronounced Stephens.

The BBB has now lowered Acacia Roofing’s rating from an A to No Rating. “Until they get this taken caring of  – possibly get a suppliers’ compensate or go a other approach obviously,” pronounced Stephens.

He pronounced during his subsequent house meeting Acacia’s membership will be revoked.

But McGinnis pronounced he has consulted authorised recommendation and is being told he is stuck. “We’re being told to compensate them,” pronounced McGinnis.

Garza said after his attribute with SRS changed, his association went into a spiral. He still owes SRS about $78,000.

Florida’s Construction Lien Law requires a executive to yield business an confirmation that suppliers have been paid, though there’s no chastisement for unwell to do so, pronounced profession Robert Underwood.

Underwood pronounced that is a large loophole in a law.

So what consumers do to strengthen themselves? Get a waiver of lien and have a executive fill it out and pointer it with a notary, before creation a final payment.
